You should know that federal and state laws require specific disclosures depending on the content of each ad and the terms offered. To our knowledge, the Ad-Slicks provided include key relevant and mandatory disclosures in required formats. For this reason, the QuarkExpress file consists of artwork that cannot be edited.

However, because advertising disclosure laws vary from state to state, dealers should run their ads by legal counsel before placing them in the media to ensure compliance with all applicable laws. These laws may also require a change in the listed MSRP.

ASMC wants you to be certain that your advertising meets all legal requirements.

In situations where ASMC shares consumer information with dealers for their use in marketing, the dealers are solely responsible for ensuring compliance with all privacy-related laws, including the do-not-call rules and any rules or laws governing email marketing. Such rules and laws may vary from state to state. Dealers are strongly encouraged to "scrub" from any consumer lists provided to dealers by ASMC any consumers that have "opted out" of receiving marketing communications, and refrain from contacting such individuals.

ASMC will NOT check and is NOT responsible for the legality of a dealer's advertising. The participating dealers shall defend, indemnify and hold harmless ASMC, its parent, subsidiaries, and related entities, and their officers, directors, agents, and employees, from and against any and all actions or proceedings of any kind, claims, damages, liabilities, costs, and expenses, including legal costs and attorneys fees, arising out of or relating to the use of the Ad-Slicks provided by ASMC. ASMC shall have the right to control the defense of any such action or claim in all aspects.

ASMC will NOT check and is NOT responsible for any dealer's telephone and email marketing practices. With respect to such practices, participating dealers agree to defend, indemnify, and hold harmless the individuals and entities identified in the previous paragraph to the same extent, and in the same manner, as set forth in the previous paragraph.
